(Davenport, IA) -- An Iowa Supreme Court Justice is recusing himself from a case involving the deadly partial collapse of a downtown Davenport apartment building two years ago.

Justice Thomas Waterman won't be on the bench when the state's high court hears arguments in early October about whether city employees are protected from prosecution by qualified immunity.

Waterman's former law firm is representing the city and former employees named in the lawsuit brought by survivors of the collapse that killed three men.
