(Cedar Rapids, IA) -- A judge overseeing the trial of a man accused of killing four people northeast of Cedar Rapids last year is disallowing the suspect's interview with police after the murders from being used as evidence.

Lawyers for Luke Truesdell argued in Linn County Court that their client had not been read his rights when police questioned him.

Prosecutors argued he wasn't a suspect or in custody at the time.

The judge says bodycam footage of Truesdell saying "I hit 'em" and pointing to a metal bar can be used at the trial which begins November 4th.
