(Des Moines, IA) -- The Iowa Public Information Board says they can't make a decision on a request to make a Department of Criminal Investigation report into the partial collapse of a Davenport building a public record.
The board says the request came in the wrong format.
Scott County Attorney Kelly Cunningham cited a seven-page summary of the report as her reason for not criminally charging building owner Andrew Wold.
Cunningham says she won't release the document to protect civil lawsuits.
May 28th will be the second anniversary of the apartment building collapse that killed three men, forced a woman to have her leg amputated, and left dozens homeless.
